ลักษณะสำคัญเรื่องมรดก

เมื่อบุคคลใดตายถ้าทำพินัยกรรมไว้มรดกก็จะตกทอดแก่บุคคลที่ผู้ตายได้ระบุไว้ในพินัยกรรม
หากไม่ได้ทำพินัยกรรมไว้มรดกก็จะตกทอดแก่บุคคลที่เป็นญาติและคู่สมรสของผู้ตายดังนั้น
ทายาทที่มีสิทธิในการรับมรดกจึงมีอยู่ 2 กรณี คือ
1. สิทธิตามกฎหมาย ผู้รับมรดก เรียกว่า ทายาทโดยธรรม
2. สิทธิตามพินัยกรรม ผู้รับมรดก เรียกว่า ผู้รับพินัยกรรม
พินัยกรรม คือ การแสดงเจตนากำหนดการเผื่อตายเอาไว้ พินัยกรรมจะมีหลายแบบ เช่น
1. แบบธรรมดาหรือทั่วไป
2. แบบเขียนเองทั้งฉบับ
3. แบบเอกสารฝ่ายเมือง
4. แบบเอกสารลับ
5. แบบทำด้วยวาจา
6. แบบทำในต่างประเทศ
7. แบบทำในภาวะสงคราม
พินัยกรรมทั้ง 7 แบบ มีแบบที่สำคัญซึ่งเป็นแบบที่ง่าย ๆ คือ แบบเขียนเองทั้งฉบับ เพราะเขียน
ด้วยลายมือผู้ทำพินัยกรรมเองตลอดทั้งฉบับ โดยมีวัน เดือน ปี ที่ทำพินัยกรรม มีข้อความตาม
ต้องการ และไม่ต้องมีพยานรู้เห็นในการทำพินัยกรรมแต่อย่างใด

ชายและหญิงจะทำการหมั้นกันได้ต่อเมื่อต่างมีอายุ 17 ปีบริบูรณ์ ถ้าฝ่ายหนึ่งฝ่ายใด อายุไม่ถึง
17 ปีบริบูรณ์ การหมั้นนั้นย่อมเป็นโมฆะ การหมั้นจะต้องมีของหมั้นและจะต้องส่งมอบหรือโอนทรัพย์สิน
อันเป็นของหมั้นแก่หญิงและตกเป็นสิทธิแก่หญิงทันที การหมั้นจะต้องได้รับความยินยอมดังต่อไปนี้

1. บิดาและมารดาในกรณีที่มีทั้งบิดามารดา
2. บิดาหรือมารดาในกรณีที่บิดาหรือมารดาตายหรือฝ่ายใดฝ่ายหนึ่งถูกถอนอำนาจปกครอง
3. ผู้รับบุตรบุญธรรม ในกรณีที่ผู้เยาว์เป็นบุตรบุญธรรม
4. ผู้ปกครอง ในกรณีที่ไม่มีบุคคลซึ่งอาจให้ความยินยอมตามข้อ 1 2 3 ได้การหมั้นที่ทำโดย
ปราศจากความยินยอมดังกล่าวเป็นโมฆียะ

2. การสมรส
การสมรสจะทำได้ต่อเมื่อชายและหญิงมีอายุ 17 ปีบริบูรณ์ แต่ในกรณีที่มีเหตุอันสมควรศาลอาจ
อนุญาตให้ทำการสมรสก่อนได้ และการสมรสจะถือว่าชอบด้วยกฎหมาย ก็ต่อเมื่อมีการจดทะเบียน
สมรสกันแล้ว
ประโยชน์ของการจดทะเบียนสมรส
1. เป็นหลักประกันความมั่นคงว่า เมื่อคู่สมรสได้จดทะเบียนสมรสกันแล้ว สามีหรือภรรยาจะ
ไปจดทะเบียนสมรสอีกไม่ได้ ถ้ามีการจดทะเบียนสมรสอีกฝ่ายหนึ่งยกขึ้นกล่าวอ้างได้โดยไม่ต้องรอ
ให้ศาลพิพากษาเสียก่อน
2. ได้รับลดหย่อนภาษีเงินได้
3. ชายหญิงที่อายุ 17 ปีบริบูรณ์ แต่ยังไม่ถึง 20 ปีบริบูรณ์ เมื่อจดทะเบียนสมรสโดยชอบด้วย
กฎหมายแล้ว ก็กลายเป็นผู้บรรลุนิติภาวะคือ สามารถทำกิจการงานได้โดยไม่ต้องได้รับความยินยอม

• ฝ่ายใดฝ่ายหนึ่งได้มาระหว่างสมรส โดยการรับมรดก หรือโดยการให้โดยเสน่หา
• ของหมั้น

3.2 สินสมรส ได้แก่ ทรัพย์สินที่

• คู่สมรสได้มาในระหว่างสมรส
